US trademark dispute in the UK

US trademark dispute in the UK

A UK based band released their debut single to all platforms including Spotify on 30th March 2020.

 

They have had a claim made against them from an artist in the US of a different genre claiming trademark infringement because they have the same artist name. The claimng artist has a registered trademark in the US and is 'under impending cancellation' according to USPTO for reasons unknown.

 

This claim of trademark infringement was made to Spotify and was passed on to the distributor Ditto Music. Spotify have made the track in question unavailable. Ditto Music has threatened the UK artist with the removal of the song from all stores and has given the band 5 days from 12th May 2020 to resolve the issue. It has provided them with the US artist contact information.

 

International trademark law states that no national trademark is valid worldwide.

 

I believe the resolution is for Spotify to make it unavailable in the US.
