Spotify using Mobile Data Despite Not Being Allowed to?

So I've suspected this has been going on for a while and it has just happened happened now again, but visibly so:

Spotify is forbidden by my iOS's system settings to use mobile data since it is obviously very data-intensive. Now I suspect that it does not always respect this setting: I went out on the balcony where there is no WiFi and I was surprisingly able to play a few songs that I'm quite sure, I did not make available for offline usage - so I thought maybe Spotify has buffered them. Going back inside I played some more songs and did nothing else that used data (synchronization using iCloud or other system services are turned off), back on the WiFi, I suspected. Then a message by my mobile operator Swisscom surfaced, saying "only 20% of monthly data volume left", which I thought was a coincidence. I played a few more songs and started downloading a playlist for offline usage. About 5 minutes later another message arrived saying "only 10% of monthly data left". I did not use anything else at the time, all apps were closed. Now, however I checked out my mobile data statistics since November 6: It appear that Spotify (all the while being not allowed to use mobile data) in fact used 616 megabytes since that date.

How can this be? Is it my fault? If not, please fix it, it could prove really expensive for your users.

I'm using the newest version of Spotify on iOS 9.2…

This happen to me too, I have Spotify restricted to not use cellular data and after running the app while driving to work for some apparent reason the app used data with out my permission! Not cool Spotify not cool! This is a very bad by or glitche in your application. Here is a picture of my settings having the application turned off but yet it used over 200 MB of my data. I'm pretty sure they this company does not want people cancelling the subscription because of this or even go further because a lawsuit?

I'm "glad" I'm not the only one with this problem… so I'm not just imagining things. I suppose it is really bad because the offline function is one of the core features of the Premium package…
